Attorney Profile

Robert P. Bergman

Estate Planning Attorney

Mr. Bergman began practicing law in 1980 after earning his J.D. and shortly thereafter concentrated on estate planning and related fields. Over the course of more than 40 years in practice, he has helped hundreds of individuals and couples plan for the orderly transfer of their assets to loved ones while avoiding conservatorship and Probate. He has always specialized exclusively in estate planning – unlike many attorneys who dabble in multiple areas – and this unwavering focus has allowed him to develop deep expertise. Early in his career, he recognized the importance of proper estate planning to avoid costly court proceedings, and he has remained dedicated to that specialty ever since.

In private practice for the majority of his career, Mr. Bergman eventually founded the Law Offices of Robert P. Bergman in San Jose. Through his firm, he offers comprehensive estate planning services and specialized legal petitions for trusts. His longevity in the field means he has handled a wide spectrum of estate matters, from simple family trusts to complex estates requiring creative solutions. For example, Mr. Bergman regularly assists clients (and even other attorneys) with “Heggstad” petitions, and trust modification petitions to “fix”  existing irrevocable trusts to remove unnecessary provisions or add in new provisions to protect inheritance for heirs. Over the years, Bob has earned a reputation as one of the most experienced estate lawyers in the region. Peers and clients alike recognize that his decades of focused practice translate into seasoned judgment and efficient strategies for virtually any estate issue that might arise.

Areas of Practice

  • Estate Planning – Comprehensive estate planning for individuals and families, including revocable living trusts, last wills and testaments, financial powers of attorney, and advance health care directives. Mr. Bergman designs plans to preserve assets, protect beneficiaries, and clearly express clients’ wishes regarding their property and healthcare decisions. A key focus is planning to avoid conservatorship and probate through well-crafted trusts and powers of attorney.

  • Trust Court Petitions (Heggstad & Modifications) – Handling specialized court petitions to resolve issues with trusts. This includes Heggstad petitions to gather assets into a trust when property was left out or not titled properly (allowing assets to be placed into a trust without a full probate). He also files trust modification petitions to fix drafting errors or update irrevocable trusts with provisions that benefit the family (for example, correcting mistakes or adding needed terms). These services often save clients time and money by efficiently addressing trust funding problems or needed changes through the courts.

  • Special Needs Planning – Creating special needs trusts and estate plans for families with disabled children or dependents. As a member of the Academy of Special Needs Planners, Mr. Bergman is experienced in setting up trusts that protect an individual with special needs by preserving their eligibility for government benefits while still providing for their long-term care and financial security.

  • Elder Law and Incapacity Planning – Incorporating elder law considerations such as planning for incapacity, long-term care, and avoiding conservatorships. Mr. Bergman helps clients implement plans (through living trusts, durable powers of attorney, etc.) so that if they become unable to manage their affairs, trusted individuals can step in without court intervention. By avoiding conservatorship through proactive planning, older clients maintain control over who will handle their finances and health decisions, rather than leaving it to a court-supervised process. He also advises on protecting assets for a surviving spouse or ensuring a smooth transition of wealth to the next generation, all with sensitivity to the needs of aging clients.
